Government Gives Up On Tougher Sentences
The government has decided not to ask the 11th Circuit Court of Appeals to look at whether or not the sentences of former Alabama Governor Don Siegelman and businessman Richard Scrushy were too low. The government had earlier hoped Judge Mark Fuller would sentence Siegelman to 30 years and Scrushy to 25 years and then decided to file a cross-appeal with the 11th Circuit after both men were sentenced in the 7-year range.
The request to the court simply stated, “On July 27, 2007, the government filed notices of appeal with respect to the judgements entered against defendants Siegelman and Scrushy…The government has elected not to proceed with its cross-appeal as to either defendant. Accordingly, the government urges the Court to dismiss the government’s cross-appeals against defendants Siegelman and Scrushy forthwith.” The remainder of the filing had to do with the number of pages the government could have in its response brief.
